Using the Warachat Platform

Who can use it. Anyone over 18! Use of the Warachat Platform by anyone under 18 years of age is strictly prohibited.
Creating an Account. Access to certain functionalities of the Warachat Platform will require you to sign up with us and to create an account on our Platform. If you create an account, you agree to provide us with accurate information and update your information, including updating the email address associated with your account, as needed for accuracy and notification. We will treat personal information you provide as part of creating an account in accordance with our terms , conditions and policy as further detailed below.
Termination. We may terminate your account at any time for any or no reason, including if you violate any Warachat policy.
Caution of members. Since user authentication on the Internet is difficult, we cannot confirm the identity of each member.
Description of announcements. Ads describe house, for sale (or for which you are soliciting offers to purchase). They can only include text and images that you provide to us. All items listed must be in the appropriate category. The seller is solely responsible for choosing the category in which he wishes to reference his ad. Acceptable Use

As part of Warachat’s Acceptable Use Policy, you agree not to use the information, services or any other part of the Warachat Platform to take any action that:

Are contrary to Warachat 's public image, goodwill or reputation.
Promote any illegal activity or content, including without limitation child or animal abuse, violence, illegal drug use, and underage drinking.
Infringe on our copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy.
Express or imply that any of your statements, activities or causes are endorsed by us, without our prior written consent in each instance.
Violate any applicable law, statute, ordinance or regulation, or encourage any conduct that could constitute a criminal offense or give rise to civil liability.
Are libelous, defamatory, threatening, harassing, abusive, tortious, pornographic or obscene.
Are hateful or discriminatory based on factors such as race, religion, gender, sexual orientation, national origin and other legally protected characteristics.
Transmit any trade secret or other material, non-public information about any person, company or entity without the authorization to do so.
Restrict or inhibit any other visitor from using the Warachat Platform, including, without limitation, by means of "hacking" or defacing any portion of the Warachat Platform.
Modify, adapt, sub-license, translate, sell, reverse engineer, decompile, or disassemble any portion of the Warachat Platform.
Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," crawl or scrape the Warachat Platform or in any way reproduce or circumvent the navigational structure or presentation of the Warachat Platform or its contents, authentication and security measures.
Forge headers or otherwise manipulate identifiers in order to disguise the origin of any submission.
Harvest or collect information about any Warachat Platform visitors or members without their express consent.

Your Content

Definition of Your Content. The Warachat Platform enables you to post, upload, or otherwise submit materials, including without limitation photos, profile pictures, messages, profile information, realised projects with their photos , store details, store logo, and products photos. All materials that you post on the Warachat Platform or otherwise provide to Warachat will be referred to collectively as "Your Content".
License and Permission to Use Your Content. You hereby grant to us, licensees and sublicensees, without compensation to you or others, a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, worldwide license (including the right to sublicense through multiple tiers) to use, reproduce, process, adapt, publicly perform, publicly display, modify, prepare derivative works, publish, transmit and distribute Your Content, or any portion thereof, throughout the world in any format, media or distribution method (whether now known or hereafter created) for the duration of any copyright or other rights in Your Content. Such permission will be perpetual and may not be revoked for any reason, including in the event of termination of any applicable Warachat program or service, to the maximum extent permitted by law. Further, to the extent permitted under applicable law, you waive and release and covenant not to assert any moral rights that you may have in Your Content. If you identify yourself by name or provide a picture or audio or video recording of yourself, you further authorize us and our affiliates, licensees and sublicensees, without compensation to you or others, to reproduce, print, publish and disseminate in any format or media (whether now known or hereafter created) your name, voice and likeness throughout the world, and such permission will be perpetual and cannot be revoked for any reason, except as required by applicable law. You further agree that we may use Your Content in any manner that we deem appropriate or necessary.
Ownership. We acknowledge and agree that you, or your licensors, as applicable, retain ownership of any and all copyrights in Your Content, subject to the non-exclusive rights granted to us in the paragraph above, and that no ownership of such copyrights is transferred to us under this Agreement. Further, with respect to Your Content in the form of photos, and subject to Warachat product and user experience considerations: (a) we will use commercially reasonable efforts to maintain the attribution of such photos as submitted by you, and (b) we will not license or sublicense to third parties individual photos or collections of photos, except in each case for Warachat Business Purposes. " Warachat Business Purposes" means any use in connection with a Warachat -branded or co-branded website, application, publication or service, or any use which advertises, markets or promotes the Warachat Platform, the services or the information it contains, Warachat. Warachat Business Purpose specifically includes the use of Your Content on the Warachat Platform in connection with features and functions offered by Warachat to our users that enable them to view and interact with Your Content.
Your Responsibilities for Your Content. By posting, uploading, or submitting Your Content on the Warachat Platform, you represent and warrant to us that you have the ownership rights, or you have obtained all necessary licenses or permissions from any relevant parties, to use Your Content in this manner. This includes obtaining the right to grant us the rights to use Your Content in accordance with this Agreement. You are in the best position to judge whether Your Content is in violation of intellectual property or personal rights of any third-party. You accept full responsibility for avoiding infringement of the intellectual property or personal rights of others in connection with Your Content. You are responsible for ensuring that Your Content does not violate Warachat 's policy, or any applicable law or regulation. You agree to pay all royalties, fees, and any other monies owed to any person, individual, or entity by reason of Your Content.
Limits. We reserve the right to remove Your Content, in whole or part, for any reason (which may include a reported violation of our policy without notice. We do not guarantee that we will publish or remove all of Your Content.
Feedback and Reviews: We welcome your feedback and suggestions about how to improve the Warachat Platform. Feel free to submit feedback at https://warachat.com/fr/contactez-nous. For the avoidance of doubt, reviews and feedback are also Your Content. By submitting feedback or reviews in this or in any other manner to us, you grant us the right, at our discretion, to use, disclose and otherwise exploit the feedback, in whole or part, without any restriction or compensation to you.

Our License to You. Subject to these Terms of Use, including the restrictions below, we grant you a limited non-exclusive license to use and access Our Content and Materials in connection with your use of the Warachat Platform. Except as expressly agreed to otherwise by us (such as your eligibility for creation of a professional profile seller, vendor, advertiser, trade, or other agreement with us), your use of the Warachat Platform must be limited to personal non-commercial use. We may terminate this license at any time for any reason. Except for the rights and license granted in these terms, we reserve all other rights and grant no other rights or licenses, implied or otherwise.
Restrictions. Except as expressly provided in these Terms, you agree not to use, modify, reproduce, distribute, sell, license, reverse engineer, decompile, or otherwise exploit Our Content and Materials without our express written permission. Warachat's permission to you for your use of the Warachat Platform expressly excludes commercial use by you of any information concerning product descriptions or professional listings for the benefit of another merchant. You are expressly prohibited from any use of data mining, robots, or similar data gathering and extraction tools in your use of the Warachat Platform. You may view and print a reasonable number of copies of web pages located on the Warachat Platform for your own personal use, provided that you retain all proprietary notices contained in the original materials, including attribution to Warachat.
Ownership. You acknowledge and agree that the Warachat Platform will remain the property of Warachat. The content, information and services made available on the WarachatPlatform are protected by algerian copyright, trademark, and other laws, and you acknowledge that these rights are valid and enforceable. You acknowledge that you do not acquire any ownership rights by using the Warachat Platform.

Reporting Violations of Your Intellectual Property Rights, Warachat terms and conditions of use, or Applicable Laws

If you believe content on the Warachat Platform violates Warachat terms and conditions of use, your Intellectual Property Rights, or otherwise violates applicable law, you may inform us.
We have no obligation to delete content that you personally may find objectionable or offensive. We endeavor to respond promptly to requests for content removal, consistent with our policies described above and applicable law.

Communications

You are not required to agree to receive promotional text messages, calls or pre-recorded messages as a condition of using the Warachat Platform. Since we do not intervene in transactions between professionals and costumers or buyers and sellers, you release us from any liability in the event of a dispute between several members for any claim, and any present or future damage, presumed or not, observed or not, resulting directly or indirect of these claims.
Warachat makes no warranty for any information or advice obtained through the services of Warachat.com.
Warachat makes no warranty for the services or goods received via (or promoted via) the services of Warachat.com or via the links offered by our services, nor for any information or any advice received via the links offered in the services of Warachat.com.
Warachat accepts no responsibility of any kind for the accuracy, content, completeness, legitimacy, reliability, operability or availability of the information or data displayed in the results obtained by the Services Warachat.com.
Warachat accepts no responsibility for damages that may result from the downloading or use of information or data available on the Internet via the Services of this site.
You declare to understand and accept that you download or use in one way or another information or data via the services of Warachat.com at your discretion and at your own risk, and that you remain solely responsible for any damages caused to your computer system or data beings that may result from the downloading and/or use of such information or data.
